Lawyer: from basic legal standpoint, if school recovers loss by enrolling another student in that place, they have no cause to hold you to pay for the spot because (in legal terms), they have already "mitigated" their damages. Now they could hold you to pay for whatever administrative expenses or lsot value they had, but not the whole amount. Just because you sign a contract, it isn't necessarily enforcable if it goes against public policy and basic contract principles.I'd seriously refuse to pay and let them come after you for the contract. NP, but I spoke to lawyers when faced with the same situation, and they said that it falls under a type of law that doesn't involve mitigated damages. Regular contract law perhaps? I can't remember what it was called, but it was different than, say, when you break your lease and the landlord is required to try to find a replacement tenant [ Reply | More ]

Another lawyer mom here and I totally agree. They won't come after you if they fill the spot because they would not prevail. BTW, it was nice of you to tell your friend you were giving up the spot. Last year, my friend gave up a spot and did not tell me even though she knew we really wanted the school and by the time she finally did tell me she pulled out, the school had already filled the spot. Yes, we were told we had priority wait list and my df knew this. No guarantee we would have got the spot, but I sure as heck would have been calling the AD had I known there was about to be an opening. So let me get this straight. TAG and the Chinatown G&Ts are "not good" because, despite great test scores, there aren't enough white kids there. Lower Lab & PS 166 G&T are problematical because of the "apartheid" there - white kids in the G&T, minority kids in the gen ed. Apartheid is a the problem - it's a bad, bad message to send to kids that racial differences are a basis to classify and divide people - there's no way those kids aren't getting that message no matter what their parents tell them. really hope so - I know that was the point of the lottery to begin with but MSC had always actively sought a diverse mix and was worried lottery might mess that up - the past couple of years they have been recruiting in less well off neighborhoods, Head Starts, etc. to make sure they don't lose the diversity. C-section is a major abdominal surgery and carries increased risks to the mom and baby when not medically indicated (a prior C-section is not a medical indication). Compared with vaginal birth, cesarean section increases a woman's risk for a number of physical problems. These range from less common but potentially life-threatening problems, including hemorrhage (severe bleeding), blood clots, and bowel obstruction (due to scarring and adhesions from the surgery), to much more common problems such as longer-lasting and more severe pain and infection. Even after recovery from surgery, scarring and adhesion tissue increase risk for ongoing pelvic pain and for twisted bowel. Multiple scars in uterus from repeat C-sections increase risks relating to future pregnancies and births, such as infertility, scar rupture in a subsequent labor, ectopic pregnancy (the embryo develops outside the uterus), placenta previa (the placenta grows over the cervix), placental abruption (the placenta separates from the uterus before the baby is born), placenta accreta (the placenta grows abnormally into or even through the uterus). Hospital stays: If a woman has a c-section, she is more likely to stay in the hospital longer and to be re-hospitalized. Emotional well-being: A woman who has a c-section may be at greater risk for poorer overall mental health and some emotional problems. She is also more likely to rate her birth experience poorer than a woman who has had a vaginal birth. Mother-baby relationship: A woman who has a c-section is more likely to have less early contact with her baby and initial negative feelings about her baby. Breastfeeding: Recovery from surgery poses challenges for getting breastfeeding under way, and a baby who was born by c-section is less likely to be breastfed and get the benefits of breastfeeding. Impact on babies: Babies born by c-section are more likely to: be cut during the surgery (usually minor) have breathing difficulties around the time of birth experience asthma in childhood and in adulthood. Impact on any future babies: A cesarean section in this pregnancy increases risk for babies in future pregnancies. Some research finds that babies who develop in a scarred uterus are more likely to: be born too early (preterm) weigh less than they should (low birth weight) have a physical abnormality or injury to their brain or spinal cord die before or shortly after the birth. But with repeat C-sections, there is more of a challenge because of the scar tissue that develops. This makes it more difficult to move the bladder away to get to the uterus, and organs can be damaged due to nicking and scar tissue. The more surgeries, the more scar tissue. I just went through this. Was going to do the vbac but went with the repeat c. If the vbac goes well then it's definitely better to have a vaginal birth. If it doesn't then it you're in a worse boat. There is a chance of rupture with the vbac, which is a small chance, but if it happens then that's horrendous. The c is pretty predictable although the recovery sucks after a week or two it doesn't really matter. I have two friends who just had vbacs and they went great and they were up and about two days later. Another friend didn't want to take the risk (she's a dr, btw) and went with the c. In the end I went with the c. I have no yearning to have a vaginal birth though, so I don't feel as if I'm missing anything. [ Reply | More ]

That's a silly generalization. My dc's private school has full day from the third day on. The Neighborhood School (a public school in the East Village) has a transition period that goes on for weeks, starting with an hour or so per day. [ Reply | More ]
