had dh call them. they threatened to pursue the matter if we did not pay the full year's tuition, so we did. df got the spot. pissed they double dipped. [ Reply | More ]

said we loved the school (which we did), but that financially it made sense to take this option which we did not have when we signed the contract. they were not exactly bice about it. happily, dh made the call. [ Reply | More ]

never expected anything, but did hope for it. also they filled the spot. told df that we were releasing the spot, she called, and they took her dc. they did not need to charge us. [ Reply | More ]

is that legal? I can see you having to pay full tuition if the school would lose out, but why should the school get double tuition for the same seat? I know that's illegal in Georgia -- we used to live in Atlanta and had the same thing happen. We didn't pay. [ Reply | More ]

entitled is a school making someone pay for something they have not lost. It is spiteful and wrong. Imagine if you asked for insurance money for a lost bracelet that you then found behind the sofa. Would it be OK to keep the money? Nope. [ Reply | More ]

Lawyer: from basic legal standpoint, if school recovers loss by enrolling another student in that place, they have no cause to hold you to pay for the spot because (in legal terms), they have already "mitigated" their damages. Now they could hold you to pay for whatever administrative expenses or lsot value they had, but not the whole amount. Just because you sign a contract, it isn't necessarily enforcable if it goes against public policy and basic contract principles.I'd seriously refuse to pay and let them come after you for the contract. NP, but I spoke to lawyers when faced with the same situation, and they said that it falls under a type of law that doesn't involve mitigated damages. Regular contract law perhaps? I can't remember what it was called, but it was different than, say, when you break your lease and the landlord is required to try to find a replacement tenant [ Reply | More ]

that would be equity law (e.g. you need a service, like having a contract with a specific performer, that cannot easily be replaced); but I think a good case can be made that students are replacable commodities, so damages can be mitigated. [ Reply | More ]

Another lawyer mom here and I totally agree. They won't come after you if they fill the spot because they would not prevail. BTW, it was nice of you to tell your friend you were giving up the spot. Last year, my friend gave up a spot and did not tell me even though she knew we really wanted the school and by the time she finally did tell me she pulled out, the school had already filled the spot. Yes, we were told we had priority wait list and my df knew this. No guarantee we would have got the spot, but I sure as heck would have been calling the AD had I known there was about to be an opening. I think my frenemy as I now refer to either purposely did not tell me or had no consideration for me. I had done her many, many favors in the past so I decided to end the friendship [ Reply | More ]
