[ - ] dh and i were talking about same-sex marriage and i said its not of the govt's business to say who is ok to get married and who is not. Societal norms have changed (ie. inter-racial marriages were illegal at one point). I also stated that assuming wives were consenting and legal age, that polygamy should be legal also. I mean, why is a same sex marriage ok, but having more then one wife or husband is not. He then asked if I believe incestuous marriages should be legal if both were consenting adults (and assuming the relationship started as adults). not really interested. I mean how many people will actually want to do this? There are more important policy issues that affect all of us. We need to increase energy supply, develop alternatives, drill ANWAR, build nuclear power plants. These things are impacting us all on a daily basis. I don't think it is the right thing to do, but I think that people tend to do so when discussing marriage because the very nature of the conversation is what is marriage, what are its boundaries, who does it apply to, at some point the law does get involved (marriage to minors, marriage to relatves) and people are trying to parce out where that line is and should be. by the way, there are a number of very practical economic policies why polygamy is illegal including how unlikely it is for a single man to be able to support that many children. In fact, in the town that was recently "raided" the average woman there uses over 700 per month in food stamps. In law school, you learn to always think about the economic implications of laws. That's fine. But the reality of lawmaking is that law, especially when it deals with children's welfare, must cater to the lowest common denominator. The reality is that polygamy tends to occur in communities that are fundamentalist and where women do not work. Law has to recognize and respond to reality. [ Reply | More ]

Double standard? Hardly. Sounds like you're talking about legislation around sex, which has (as we all know) very little to do with marriage. Marriage exists in order to promote a stable community. In other words, the only reason government is involved in the personal lives of people is because those personal lives affect the state. For instance: married people are more likely to stay together, to raise children together, to form a stable unit that promotes the interests of the community. I had this same issue, although my BF had been trying for years and it took me 3 tries. We went out for dinner & I told her. She acted totally happy for me, although she may have been putting on a bit of an act to cover. I know she was genuinely happy, I just also know it had to hurt a little. Be gentle and not overly jumpy and crazy excited when you tell her. I also kept my pg complaints to a bare minimum when talking to her. Same w/ my dd complaints now. [ Reply | More ]
