Yes and no. Testing as a condition for release would be a violation of their rights, but the gov't is responsible for an inmate's medical care during incarceration, so HIV testing is usually done as part of the intake process, along with TB testing, etc., so they know who needs regular medical care and/or maintenance medication (blood pressure meds, insulin, etc.) while incarcerated. that makes sense, but to answer the OP, then, it IS a violation of rights if for release. I guess, if you went in and did it a month before release, fine, but no guarantee it won't be contracted in that month, right? [ Reply | More ]

correct. it cannot be a condition of release, but the prisons aren't going to test inmates unless they have reason to suspect a new infection. a negative test upon entry into the system is presumed to remain negative until there is reason to believe otherwise. [ Reply | More ]
