Tough Situation. I am living with ex-boyfriend in his family's house (they retired and live elsewhere). Ex wants to fight for primary custody and no support. If I move out tomorrow with DC - will I be in legal trouble??? [ Reply | Watch | Flag ]

In my state (and might be every state), either of you could take the child and move to a different home (I can't move more than 60 miles from my ex, unless he says i's ok). What you need to do is consult a family law lawyer (does not matter that you're not married) for a free consultation about custody issues, especially for not marrieds. [ Reply | More

There is no reason for him to have primary custody, really- are you abusing your child? are you a drug addict? Ie, custody is mostly shared these days unless there is a reason not to. For ex,my exdh travels for his work 1-2 wks/month, and it is unpredictable,so I have primary physical custody,but we share legal custody (the two are different, pls note). Start googling. np: i agree w/you, sort of, but life is not black and white like this. Following your reasoning, physical abuse, mostly perpetuated by men on women, is the woman's fault, for "getting herself in this white trash situation". Or rape: the woman drinks too much, gets raped, and bingo- "she got herself into that situation" herself. So, yes, op needs to start taking care of herself better, but that does not mean that if she started working or living in her own house, her custody situation wd be different, or her boyfriend would become a better person. yes, but now she is dragging a dc into this mess. it is more long term than a night of boozing and getting raped. she made a child with this guy, lived off the family, did not earn a living, did not get married and now is up a creek. would just like a bit of acknowledgement from her that she has screwed up her kid, not just herself.
