Divorced moms/lawyer moms - separated and right now I have temporary custody with ex. haven't been able to get in touch with my lawyer (need to switch lawyers too!) but trying to figure out if/and with what consequence if I moved out of state (NYC to NJ). ex currently lives with sister in queens and I can't afford to stay in nyc. I assume I can't move out of state? [ Reply | Watch | Flag ]

I think it depends on the agreement, sometimes there is distance requirement rather than state. I am sure your ex would prefer you move to Hoboken over Buffalo, even if it is not the same state. Can you talk to ex about signing off on it? [ Reply | More ]

it definitely depends on the agreement. i imagine that there is no explicit written agreement yet because your divorce isn't formalized (unless you separated pursuant to a separation agreement?) if there is no written agreement, you can ask him to agree to the move (get it in writing!!!). if he doesn't consent, you'll need to petition the court. it is very hard to get the right to move far away -- it is a best interest of the child standard, and if the father has done a good job maintaining his relationship with the kids you will have a tough time getting a court to let you move unless you have a very compelling reason. a close move, that won't interrupt his visitation, will be much easier to get approved.
