A child's residence is usually the same as the residence of her parent or custodial parent. If school officials have doubts about custody or your proof of New York City residence, they can investigate (a "407 Investigation") to see if you are the child's sole caretaker or if you live where you say you do. During the investigation your child has a right to continue attending school, under the provisions of Chancellor's Regulation A-101 4.1. [ Reply | More ]

If a child's parents are separated or divorced, the child attends school where the parent who has primary custody lives. If the custody is shared, the family may determine the child's official residence. [ Reply | More ]

If a parent and child live with another family or relative and do not have a lease in their own name, they may request that the leaseholder write a letter stating that they live in that apartment. The school officials may check to see if the child actually lives at the given address – and may make a home visit to see if the child has clothes and toys at that address. [ Reply | More ]

A child who is not residing with the custodial parent may be excluded from the school zoned for the area where she does live. If, for example, a student lives with her grandmother, but her father (who lives at another address) is still her parent -- meaning he is responsible for his daughter's welfare -- then his daughter does not have a right to attend the school in her grandmother's zone. Only if her father had abandoned her or was for some reason incapable of taking care of his daughter, would the grandmother's residence be the girl's residence and the place that determined her school zone. This policy was largely devised as a way to make sure that families were not letting their children move in with relatives as a way to take advantage of better schools in that zone. [ Reply | More ]

Why is the student living with others? If the sole reason for living with others is to permit the student to attend a certain school or secure a transfer from his/her current school to another school for which he/she is not eligible, then the student’s residence is not established there. VERIFICATION OF RESIDENCY A. Proof of address must be provided when enrolling a student in school. The following documents may be used as proof of residency: 1. A telephone bill, cable bill, credit card bill, medical insurance card, or driver’s license is not acceptable proof of address. Proof of address may be verified by any two of the following: a. a residential utility bill (gas or electric) in the resident’s name issued by National Grid (formerly Keyspan), Con Edison, or the Long Island Power Authority (for the Rockaways) within the prior 60 days; b. documentation or letter on letterhead from a federal, state, or local government agency, including the IRS, the City Housing Authority, Human Resources Administration, the Administration for Children’s Services (ACS), or an ACS subcontractor indicating the resident’s name and address issued within the prior 60 days; c. an original lease agreement, deed or mortgage statement for the residence; d. a current property tax bill for the residence; e. a water bill for the residence; f. official payroll documentation from an employer issued within the past 60 days such as a form submitted for tax withholding purposes or a payroll receipt. Falsification and Investigation of Residency If there is a question about a student’s address or there is suspicion that a falsified address was used to register the student, the school must initiate an address verification investigation within 30 days of discovery of the problem. If it is determined that the student resides at an address that renders the student ineligible to attend his/her current school, the principal must provide the Attendance Content Expert of the ISC with the results of the investigation. OP here. Y'all need to CALM DOWN. I am in no way advocating turning someone in. I know several families who cheated their way in, and would never say anything to anyone. It's not the child's fault, and I wouldn't want to hurt the child, no matter how I feel about the parents. However, I also have connections at the DOE. And I see lots of people here speculating on what is and isn't OK. There's no point speculating when the information is clearly out there, so I posted it to be helpful. This was geared to help people make choices, really informed choices, about methods to get their child into an out of zone school. I understand that UB is a bitchy place, so I also understand why the worst possible motives were attributed to me. But that isn't the case, so get over yourself. [ Reply | More ]
