to the mom whose DH has a year-long affair with 21 yrs old nanny: could you sue the nanny? for breech of fiduciary duty? i mean, where were the kids while they were doing it? wasn't she supposed to be with them? what do you think, lawyers moms? [ Reply | Watch | Flag ]

I guess I should say, you can always sue someone, but I think the claim is baseless, you have to prove a legally recognized fiduciary duty, and I don't think you'll win here. But if you are in North Carolina, you can sue for alienation of affection if you can prove you had a great marriage before nanny lured dh into the affair. [ Reply | More ]

too bad. it is awful that the nanny was doing it while on a job, and she will get away with it. i mean, if i was sleeping with someone at work during work hours i would be fired and bear some consequences, not mentioning no references for a future job... [ Reply | More ]
