Am I wrong? I pay my nanny on the books. This involves buying worker's compensation insurance and disability insurance. She hurt herself while at work and wants me to pay all of her medical bills. She doesn't want to file under worker's compensation because despite my paying on the books, she hasn't been filing an income tax return. I refuse to pay the medical bills. Am I being unreasonable? the fact that she's even bringing this up would not sit well with me. It speaks to her character. She's not only stealing from the government by not filing taxes, she also wants to steal from you by asking you to cover something she's responsible for. [ Reply | More ]

I think you are responsible for an employees medical bills if they are hurt on the job. If I was hurt at work, I would insist that my company pick up the full tab for my medical treatment. [ Reply | More ]

I think there's different kinds of "hurt on the job" though. It's one thing if our job involves heavy machinery and the risk of being injured exists, but if you drop a heavy file and break your toe at the office, your employer pays that medical bill? [ Reply | More ]

OP: Workers Compensation should cover the entire cost of treatment. But she won't file. I bought the insurance so that I wouldn't face a huge financial risk by employing someone in my home. I can't just agree to cover her medical bills without limit. [ Reply | More ]

If insurance pays for lost wage and medical bills, you shouldn't pay any other. Personally, I would fire an employee that is so unethical that she won't pay taxes. It's illegal not to pay taxes and why would you hold onto someone who does illegal things? [ Reply | More ]

OP: I didn't know until now that she wasn't filing. I pay A LOT more in order to pay on the books (higher salary, payroll taxes, etc) and I have the cost of a payroll service. [ Reply | More ]

I don't know how workers' comp works, but if it pays all her medical bills plus lost wages for time lost at work, then too bad for her if she's not filing her taxes. That's a choice she made. You shouldn't have to pay twice. [ Reply | More ]

OP: Workers Comp should cover the medical costs. She has disability insurance for potential lost wages at work. But she wasn't actually out of pocket. She called me when she hurt herself. I paid her for that day and the following day. After that, she returned to work. [ Reply | More ]

She cut her hand while washing dd's dishes. She went to the ER, had an x-ray and MRI, needed stitches, went to a hand specialist, and will need a half day to get the stitches removed (I will pay her for that half day). [ Reply | More ]

If you really don't want to lose her, pay the medical bills BUT you have to require her to pay her income tax - make sure you will let her go if she doesn't comply. [ Reply | More ]

When I freelanced for my company, I had to sign a contractor's agreement in which I was responsible and not the company for paying taxes. My coworker used that agreement with the nanny. Anyway, bad idea to hold onto an employee who's "hiding from the law." [ Reply | More ]

dh used to consult for the irs right after graduate school-they go after the little guy more frequently (or used to). i forget the logic-something like word of mouth of how bad process is if you get caught as an incentive not to cheat. [ Reply | More ]
