I have been so challenged and down, I don't think I have a lot to fight anymore. I am a 28 year old fulltime nursing student without family in the United States. I moved here because of my husband. He is emotionally and physically abusive. I want out of the marriage but he is determined to take the children away from me. Based on the law and his assets, I think he has a stronger say. I am trying to find a full time job doing anything, to boost my income. Does anyone here know of low cost legal advice? Any suggestions or general advice is also appreciated. Thanks. I don't, but I'm sure someone here can point you in the right direction. One thing I do know is, unless you have substance-abuse problems or plan to take the children out of the country, the courts will usually always side with the mother in custody issues, regardless of dh's assets. You do have options. If you are in NYC, call 311 to get connected to shelters for abused women. The staff at those shelters can connect you to legal services for free (the lawyers are volunteers). There is no presumption that the income-earning parent will automatically get custody, but there is a presumption that an abusive parent will not. Good luck! [ Reply | More ]

also, start calling the cops when he's physically abusive so that you have proof of it. [ Reply | More ]

Contact InMotion. It is a non-profit organization that helps low-income women with matrimonial and child custody cases, among other things. My law firm, and many others, do many pro bono (free) divorce cases with them. The website is www.inmotiononline.com. The phone number in Manhattan is 212-695-3800 and in the Bronx is 718-562-8181. Good luck. [ Reply | More ]

^^ oh, and as I'm sure you know, you can work in a hospital as a nursing student. Benefits and all. Pay is not as good as it will be when you finish, but it's great for getting your foot in the door, getting the department you want, and the right hours. [ Reply | More ]
